Terms of Service
Effective October 16, 2026.
These Terms are an agreement between you and Zach Asbury, who operates Rally ("Rally", "we", "us"). They cover the Rally iPhone app and the website letsrallytonight.com. By creating an account or using Rally, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use Rally.
1. What Rally is
Rally helps adults find events and go to them with other people. Events ("rallies") are hosted by users or found from public sources, and take place at third-party venues. Rally is a platform. We don't organize, run, supervise or vouch for the events, venues, hosts or other users.
2. Who can use Rally
- You must be 18 or older. Events that involve alcohol are for people 21 or older. You must give your real date of birth. We don't check ID; venues do.
- You must be allowed to use Rally under the law where you live, and not be barred from using it under these Terms.
- You must give accurate information, use a profile photo that is genuinely yours or that you have the right to use, and keep your sign-in secure. You are responsible for activity on your account.
3. Meeting people in person: your risk
Rally can't screen or verify the people you meet, and we don't conduct background checks. Rally's tools, such as "Here" and "On the way," show what phones report, not who anyone is or whether they are safe. You are solely responsible for your decisions and your safety when you attend events or meet people. Use good judgment: meet in public places, tell someone where you're going, arrange your own transportation, drink responsibly, and leave any time you feel uncomfortable. In an emergency, call 911.
To the fullest extent the law allows, you accept the risks of attending events and meeting other users, and you agree that Rally and its operator are not responsible for what users or venues do, for events, for injuries, losses or damages that happen at or because of them, or for disputes between users.
4. Your content and conduct
You keep ownership of what you post (profile, photo, messages, event listings). You give Rally a worldwide, non-exclusive, royalty-free license to host, store, display and use it as needed to run Rally. You promise that you have the right to post it.
You agree not to:
- harass, threaten, stalk, bully, discriminate against or exploit anyone, or pressure anyone to meet or share location;
- post sexual, hateful, violent, illegal or misleading content, or use another person's photo or identity;
- use Rally for dating-style solicitation, sex work, selling goods or services, advertising, spam, scams, or anything illegal;
- host events at places that aren't real public businesses, or create fake events, attendees, counts or check-ins;
- fake your location, bypass age or safety rules, or evade a block, suspension or ban;
- scrape, reverse engineer, overload or attack Rally, or collect other users' information;
- promote or encourage excessive drinking or underage drinking.
See the in-app Community Guidelines and safety tips for more.
5. Moderation and ending accounts
We can filter, refuse, remove or hide content, cancel events, and warn, mute, suspend or ban accounts, at our discretion and without notice, including to keep people safe or to follow the law. Reports are reviewed by people. You can block and report anyone. You can delete your account any time in the app (Profile, Privacy & settings, Delete account). We may keep certain safety records as described in the Privacy Policy. Sections that by their nature should survive (like 3, 4's license for already-shared content, 8, 9 and 10) survive.
6. Events, venues and third parties
Events found by Rally come from public sources and are shown "as is": times, prices, details and availability may change or be wrong, so check with the venue or organizer. Venues, ticket sellers, map apps and other third-party services have their own terms and privacy practices, and we're not responsible for them. Mentions of a venue, team, brand or show don't mean they sponsor or endorse Rally.
Some found events come from SeatGeek. SeatGeek, Inc. and its affiliates are third-party beneficiaries of these Terms: the disclaimers and limits of liability in them protect SeatGeek too, and SeatGeek can enforce these Terms against you. SeatGeek doesn't sponsor or endorse Rally.
7. Location, notifications and other features
Some features need location, notifications, camera or Apple Music access, which you control in iOS Settings and in the app. Features like "On the way," "Here," crowd counts and live location rely on your phone and may be delayed, inaccurate or unavailable. Don't rely on them for safety or emergencies. Don't use your phone while driving. See the Privacy Policy for how we handle data.
8. Disclaimers
Rally is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise that Rally will be uninterrupted, error-free or secure, that events will happen or be as described, that anyone will show up, or that you will have a good experience or make friends.
9. Limit of liability
To the fullest extent the law allows, Rally and its operator, and anyone who works with us, will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, or for personal injury or property damage arising from meeting people or attending events, arising out of or related to Rally. Our total liability for any claim is limited to the greater of the amount you paid Rally in the 12 months before the claim (currently nothing, since Rally is free) or $100. Some places don't allow some of these limits, so they may not fully apply to you, and nothing here limits liability that can't be limited by law.
10. Indemnity
You agree to defend and hold harmless Rally and its operator from claims, damages and expenses (including reasonable attorney fees) arising from your content, your events, your conduct, your meetings with others, or your breach of these Terms or the law.
11. Disputes and governing law
Maryland law governs these Terms, without regard to its conflict-of-law rules. Before filing a claim, please email us at letsrallytonight@gmail.com and give us 30 days to try to resolve it. Claims must be brought in the state or federal courts located in Maryland, and you consent to their jurisdiction, except that either of us may bring an individual claim in small claims court. To the extent allowed by law, claims must be brought individually, not as part of a class action, and must be filed within one year after they arise.
12. Apple
If you got Rally from the App Store, these Terms are between you and us, not Apple. Apple has no obligation to provide support or maintenance for Rally and isn't responsible for claims about it. Apple and its subsidiaries are third-party beneficiaries of these Terms and can enforce them against you. You must follow Apple's media services and App Store terms.
13. Paid features
Rally is free today. If we add paid features (such as Rally Pro), the price and terms will be shown before you buy, and purchases will go through Apple. Safety features will never be behind a paywall.
14. Changes and other terms
We may update these Terms. If a change is meaningful, we'll tell you in the app or by email before it takes effect, and your continued use means you accept it. We may change or end Rally at any time. If a part of these Terms isn't enforceable, the rest still applies. Not enforcing a right isn't a waiver. You can't transfer your account or these Terms; we may transfer ours in a sale or restructuring. These Terms and the Privacy Policy are the whole agreement between us about Rally.
